The immunity case delay is not due to any fault of the prosecutor. The Supreme Court should never have agreed to hear this specious idea that a president can be immune from any criminal activity while in office. That notion is garbage. Not sure why you didn’t mention this. Also why didn’t you talk about the fact that Clarence Thomas should have recused because of the obvious involvement of his wife in the January 6th insurrection? That isn’t Jack Smith’s fault. The damn Supreme Court is corrupt!

Adam, what a sad state of circumstances we have come to witness involving the rightful prosecution of tfg. The one I am most angered about is how long it took Garland and the DOJ to act after your J6 committee ended and issued its extensive report. I watched every minute of the hearings and thought that there would be no hesitation on the DOJ’s part in beginning their work. Your committee laid bare the actions of tfg and his personal “militia” in January 6; I was stunned at all that was uncovered and collaborated by credible witnesses. I was so extremely disappointed that the chicken shit Republicans (except the brave 10) didn’t vote to impeach. I understand that investigations and building a case takes time and immense attention to detail in order to lay out the facts, but I echo your sentiments. What are the courts, judges so scared of? I assume some think that it will tear the country apart, throwing us into civil unrest or maybe even a war as some have threatened, if tfg is tried, convicted and thrown into jail. But what about the expectations of the other side of that coin? What about those of us who clearly see that it tears our country apart by NOT holding him accountable to face the consequences, rightly so, of his actions? Only difference is those of us who take that position aren’t threatening violence against his supporters. This mess gets laid at the feet of those congressmen/women who passed the buck and Garland for the delay. As I’ve said before it’s up to we, the people, to save our democracy. I pray that we do.

We built a Country that stands by the principle of innocence until proven guilty. But, today, we have a burdensome justice system that has moved away from "swift" with it's preponderance of "Harry Potterish" layers of administrivia and burdensome regulation, and frankly, putting politics before justice. I believe justice will out and Trump will get his just desserts in all the courts and in all the cases. But "swift" will have to wait. There is a phrase in the Jesuit Educational realm bestowed on the reluctant: "JUG", stands for Justice Under God. We need to stand firm and apply the law as we have it today. Ultimately JUG applied is Eternal. It will also apply to DJT.

“Never underestimate the power of stupid people in large groups.”

I couldn't agree with you more. When I see interviews with Trump supporters, although we are not supposed belittle working people (an aside, aren't Dems working people?) the strong Trump supporters only read propaganda and their thoughts and ideas are so wrong and show a complete lack of critical thinking skills it's shocking. Indeed! I watched the Jan 6 Committee do it's amazing work, transfixed because I had also watched, in horror, as much of that infamous day was live-streamed and I truly feared a successful coup. Thank God for the brave Capitol Police.

And much thanks for the Jan 6 panel of intelligent and brave members, especially you and Ms. Cheney, who were willing to join with others to seek truth in the midst of mind-blowing denial and apparent submission by most other GOP members to the Trump cult. It's hard to believe we are still trying to find our way out of the morass of insanity brought about by this man from day one of his administration in 2016. It's exhausting, but I hope to see an end before I leave here (I'm 70 y/o) so I can feel that my children and their children will only see his awful legacy in the rearview mirror.

As for Mr. Garland; disappointment is insufficient. I have actually written to him to let him know that, as a left-leaning independent supporter of President Biden, I am distraught to see the DOJ perform so poorly under his leadership. While I do appreciate the need for them to be absolutely nonpartisan, they seem to have gone too far and now appear inept.

Special thanks to you for continuing to fight the good fight. Your family has every reason to be proud!

As I worked through the pandemic, Friend Adam, I brought a case of employment termination without cause (my employment termination) to the attention of the state of Pennsylvania. My case sat unnoticed for 3 years. I ate the loss, but I owe the state no favors. Merely legal compliance. If the wheels of justice move too slowly to keep that ole dirtbag from facing justice, I think you might see a cooperation of Left and Right that rarely occurs. Just a hunch I am having. Best wishes from Pennsylvania.

The ultra-rich are moving us toward a Russian-style oligarchy. They have purchased newspapers, cable TV, and now the internet. Trump and the Russian loving MAGA are spearheading this effort. Wealthy criminals have always enjoyed preferential treatment. 2008 was the point when it transitioned to immunity. The phrase too big to fail should have been TOO RICH TO JAIL. None of the billionaires who engineered the financial fraud went to jail. Trump really believes he is TOO RICH TO JAIL.

Mark, I respectfully only agree in part. The rich, and the ultra-rich, have owned most everything since the beginning of a currency-based market. Yes, I agree, not all of them became rich or ultra-rich using the most genteel or employee-conscious methods, but what I believe you are not considering is that if they get the notion to stomp with big, big boots, they'll find themselves with worthless toys, worthless employees, and worthless empty buildings. I see no trace of a class war with the ultra-rich. What would motivate them when they already own most everything? Yes, I have read a lot of science fiction and political "what if" stories. Mark is right Read Project 2025 highlights. I came from that group - but not the Ultra rich - just the wannabes but definitely the 1%. The second generation ripped off the Tax System “semi legally”. I was told that were not enough trained IRS agents audit what they did international money movement - that’s what the very rich people do. The others had stuck me with a huge debt so I decided to flip on them. My local Democratic Congresswoman was informed because the people I knew moved a lot of money! The IRS needed more forensic auditors to catch these rich people moving money offshore

The ultra live in the USA and use our police, our roads, our fire departments, our National Guard - but they don’t pay taxes!!! Because of the Republican tax cuts which Trump plans to - per Project 2025 - make permanent.

Excellent article and comments as well. Garland has been a disaster. One wonders hoe he’d have been on SCOTUS. Certainly less damaging than where he is now. But the reality is that with a federal judiciary polluted and compromised by appointees of tfg, including especially SCOTUS, our only hope is a blue tidal wave in November so overwhelming it can’t be overturned. And then fast, massive legislative action by Congress to try to steer the ship of state in a decent direction again. I just don’t see that happening. The plutocratic-controlled media, which give the Orange Excremental daily coverage and President Biden minimal or negative coverage, pretty much guarantee that. I remain hopeful but pessimistic, resolved to do all that I can (sadly little as a very disabled, largely homebound 76-year old) to help turn out the blue vote everywhere, for every office. Everything true Americans hold dear is on the line.

Here’s the fundamental difference between the excellent work done by the J6 committee and the courts—the committee performed an investigation using the power and resources of the federal government, and then presented its findings. The Trump TRIALS are criminal matters that require due process, and courts are understandably cautious in insuring that no due process right is violated. Are they being overly cautious? Certainly Cannon is. Judge Chutkin is doing all she can within the legal restraints she has imposed on her. The “jury is out”, as it were, on whether the Supreme Court is playing games for Trumps benefit or is acting appropriately.

The civil matters moved pretty fast, because only money was at stake. But with all eyes watching, and a former president’s liberty at stake, it’s important to get it right. The cynic in me says some in the courts are cowards and don’t want to have to decide anything until the election is over. Again, in Cannon’s case I believe this is true. But, as the saying goes, better to do it right than do it over. And in many ways our criminal justice system is on trial here. Striking a balance between giving special treatment to the wealthy and privileged vs swift justice is hard to balance. And Trump has unlimited resources on tap to give him the delay he desires. Most defendants don’t have the resources to bring every conceivable motion and appeal every adverse ruling. When they do, it takes time to exhaust these avenues. And “exhaust” is the operative word here. Trumps greatest strength is his ability to never give up. He just wears everyone around him out. He’s playing the system, and if justice delayed is justice denied, he’s winning. But it’s what we’ve got. Better to see a thousand guilty go free than one innocent wrongly imprisoned? Sometimes frustrating, but yes. It’s what we’ve got, and I’m glad of it.

Expand full comment

You’ve very eloquently and simply explained how the process works to those of us who are struggling with the seemingly slow wheels of justice. Thank you for enlightening us. That must be why the average “Joe” who steals government documents (as in these recent two cases) is quickly tried and convicted and on their way to prison in a matter of months, or so it seems to us laymen.

Expand full comment

I appreciate your frustration, truly. But I think there might be a possibility that what we are seeing is a leave no stone unturned to avoid appeal process in the delayed papers case. Many of the papers received were noted by the judge as having no application to the case hence the initial delay. He then proceeded to excoriate the defendant’s attorneys for their endless attempts to produce “evidence” that would allow their client to “escape justice”. A positive reaction to this unseemly delay might be the exposure of decades-long waffling by some politicians (on both sides) as not only illegal, but immoral.

After all, these pols and their supporters have had decades to build their labyrinth of lies. It may take labyrinthine legal activity to take down what they’ve built. That is the golden secret to the Rule of Law. Without it we would be facing what Russia faces right now. Have you seen the faces of the captured “terrorists”? Islamic extremists have claimed responsibility, these appear to be Islamic faces that are covered with bruises, and we’re supposed to take Putin’s word for it that Ukraine is somehow responsible for the event?

Expand full comment

Patricia; exactly what stone is unturned on the immunity case? The Circuit Court panel made a flawless ruling on the claim of total immunity. The Supreme Court should have never agreed to hear this case. The stones were definitely examined from top to bottom. The notion that there is more to it is bovine excrement!

I am also skeptical, but reserving judgement until I see the Supreme Court ruling. Is there some issue that in fact should be resolved fully and finally by the courts? I agree the court of appeal ruling was seemingly flawless, but does the court feel it necessary to delve further into the issue of what constitutes an official act? Or what happens if an official act is illegal? The court of appeal narrowly defined its scope and ruling (as did judge Chutkin). But is the SCCT so constrained? At some point we will know if the actions of the highest court were indeed necessary, or simply the most compelling argument possible for instituting term limits and court packing by Biden and Congress.

After, reading everyone's comments, I have just a couple of thoughts:

Adam, I certainly feel your frustration! Especially after you sacrificed your political career to do the brave thing being an important leader on the January 6th committee! I really hoped today would lead to trump's total undoing. On the bright side, the more he thinks he's winning, the harder he falls 🤞.

In the justice system, we're in uncharted territory. The country has never faced such a corrupt president before. So, do you think they'll be smart enough to change laws in Congress and the judicial system?

I really feel frustrated after just watching how a black, young man was convicted and jailed for a long time for something he couldn't have done. This happened because of inept counsel and a faulty witness. Long story short, he did get out a decade later due to someone not giving up. My point is, the justice system does work differently for the poor and the rich. We have to do better! Also, could it be that Garland inherited a justice system that left A LOT undone and he's been playing catch up? Same with Biden cleaning after his predecessor?

Lastly, can it be that trump's and Mitch's plan to fill the court's with their -favored judges has made a difference (Cannon) for one?
