This was nothing more than a deflection and delay tactic. They’ll send it back to the District Court to review, making any chance of a trial moot, until after the election.

It’s interesting how the SC took the Colorado voting case immediately. Refused to hear this case when Smith originally asked the court to do so after the District Court ruled in Smith’s favor, so it could avoid the Circuit Court and any further delays. They do this all the time for ”time sensitive” cases; just not this one.

In Bush v Gore they stopped a constitutionally mandated recount, handing the presidency to a republican. Now they are stopping a trial from taking place which would allow every citizen to know whether the Republican presidential nominee and former president is a crook!

If any one believes that this court is legitimate, I suggest you find yourself a good therapist. Trump was right about one thing when he said, “the system is rigged!” He just decided to leave out the last part of the sentence; “in his favor!”….:)

Amen Robert.

Agree,Robert. This court is very illegitimate! In 2024, if Democrats control White House, Senate and House, they should expand the court to 14 and put liberal judges under 50 on the court. I wasn’t always for expanding the court but the way they have been ruling, they will rule against every Democratic President unless the Democrats do something about it.

Agreed, but wishful thinking. They would need at least 60 senators to accomplish changing the justices on the court or adding term limits….:)

Donald J Trump is a clear and present danger to the United States. We ignore or downplay his pronouncements at our peril. And now, that the Supreme Court has revealed itself to be a majority-theocrat Court, we have no guardrail against the criminal activities of a felon-president. If we don’t vote against Trump in numbers that defy precedent, then we lose our democracy. It is that simple.

Expand full comment

Exactly. It is ultimately up to us, the citizens of this democracy to save it from the idiotic orange man-baby and his sycophants in November. The Congress didn’t do it when they had a chance (chicken shit legislators - especially McConnell who said he wanted the courts to deal with orange man-baby after he voted no to impeachment the second time) and now it looks like SCOTUS if going to sit on their hands in a despicable partisan mess)

No guardrails whatsoever. Guardrails are only good if there are people to enforce it. Even the SCOTUS is truly impartial, they don’t have an army to make people do things. JD Vance already said just break the law and dare the courts to act.

What's more appalling is that at least a few of the Supreme Court Justices seemed receptive to the Trump argument.

Yes, and is it not the USUAL SUSPECTS?!!!!! Hideious.

Obviously, they are not paying close attention to how Trump treats his advisors when they dare to say he can’t do something. Anyone heard of Sessions?

Adam why are they constantly referring to "if" ... What was Jan 6th a dress rehearsal ??? Some rehearsal ...unreal ... And yes I agree with you totally on Trump...just a mobster... nothing more...

Exactly, Martin Cahill. Questions that postulate on future presidential criminal acts, revenge litigation, or essentially as you say, how many coups d’etats should SCOTUS allow an elected official before confirming it is a criminal act. It’s a sad day for those of us who had faith in the system.

Well, they only need to let him have immunity on this one. Do they really think he wouldn’t come after them some day if he had immunity to even get away with murder or nuking some country whose head of state mocked him?

It is all Trump's fantasy. He is a strongman boss and all fall in line under him. Unfortunately, his fantasy bleeds over into our lives. He is holding us hostage with the damage that he has done already.

The Supreme Court can rule that Presidents have immunity. It will be a grave mistake if they do. They can't give only Trump immunity even though that is what he wants. Should they give immunity, then Biden can order Trump arrested and executed plain and simple.

My great aunt Callie could have beat the crap out of Trump with him crying and screaming. Most people could. That is Trump: a spoiled little brat full of fear in a 77 year old body.

This is all his fantasy. It needs to end.

I think Trump is petrified of Putin. Scared to death.

I could not listen to the conversation Trumps lawyer was having with the Supreme Court. I have no faith in them. It’s very discouraging to say the least!!!

In a Biden win with both houses he should pack the courts.

Expand full comment

Let's call it repair the Supreme Court, rather than "pack." The point is not tit-for-tat D v. R, it's placing intelligent, fair-minded jurists on the Court who actually protect our Constitution and Democracy. Plus, attorneys who paid attention during law school to the classes on Constitutional Law and Ethics. Shouldn't be a high Bar (pun intended) to clear.

Expand full comment

I don't like the idea of "packing" SCOTUS because, (like the current court makeup) it is too partisan. I prefer a Constitutional Amendment that requires an equal number of Justices from each major political party BEFORE the Court can hear cases or issue rulings. A "major political party" can be defined and agreed upon by those drafting the Constitutional Amendment. If a SCOTUS vacancy occurs and the vacancy is from a political party other than that of the President, the President MUST select and nominate a candidate from the political party that the vacating Justice represented. This Constitutional Amendment must also require Congress to confirm or deny each nominee within a certain timeframe to prevent a "blockade" of the vacancy by any single party. While a SCOTUS vacancy exists, the most recently confirmed justice(s) from the other political party(s) must temporarily recuse themselves in order to restore political balance to the Court and allow it to continue hearing cases and issue rulings. Once the newly confirmed Justice is seated, the temporarily recused Justices can return to their seats on the bench to hear cases, issue opinions and participate in rulings. In my (feeble) mind, this might be a good way to bring Political Balance to SCOTUS and allow them to better focus on their fundamental (and in my opinion ONLY) task -the Law. Just my thoughts... I'm sure there are many here who can improve on it or come up with a better idea.

I concur with you and Mike! Sounds like something Adam's cabinet member would propose in the future White House 🤔🤞🙏!!

Also, please other Constitutional Amendments needed because of the corrupt #45 presidency that our forefathers couldn't foresee detailed laws we would need.

There are 13 appellate courts, so there should be one supreme court justice for each.

It’s been done before.

Adding Justices just starts a trend toward adding more and more Justices. It'll never end. I think clear conflict of interest laws that establish grounds for removal and an approprately long term limit (like 10-15 years) would be better.

Trump is a mobster, dictator, abuser, thief, traitor, crook-the list goes on and on and we’ve put up with it long enough! This all has dragged out way too long and needs to end, period!

So if SCOTUS rules completely in Trump's favor, Biden could order his political rival killed and that would be part of his official duties, correct? I just want to make sure I have Trump's legal position correct. :-)

The reason this would be so dangerous is because Biden would never have someone murdered, but Trump would.

far too much lawyering and no common sense - learn from past, deal with the bully and get back to basics - 2 cents from an old Canadian lawyer and Adam Kinzinger supporter/follower (seems we need more leaders with brains and souls on both sides of the border)

A chill went up my spine as I listened to Sauer claim that an assassination ordered by a president could be an official act. Gorsuch, Alito, and Thomas's remarks and questions stunned me.

We are in for a long and historic fight. Democracy must win.

He is above the law! Adam if anyone else did what that prick did, it would have been over years ago. If Obama had said some of the things that trump said, they’d find him guilty and executed him for it.

So true Cynthia!! The Supreme Court truly has me worried. I wonder if they realize that most Americans recognize their biased actions!! It bothers me that there is nothing we can do!! Who created this Supreme Court anyway? Didn’t anyone realize that they are only human and might succumb to the wrong side of the law?

This scares me greatly! Surely there are level heads on the supreme court that would vote no to immunity. One of them could be targeted for assassination if presidents have full immunity.

Ugh. And Fox and Trump have 75 million people conned into thinking he is the second coming. I wish I could say it was only the poorly educated that want him to regain power. But my dentist, my doctor, the county assessor, etc. All want Trump in power. We have to strengthen the blue vote and vote him out!!!!!

He is all of what you say, Mr. Kinzinger. And his cultists love this perverse anti-Robin Hood who delights in stealing from the poor to give to the rich. He should be very concerned if SCOTUS blesses broad Presidential immunity before January 25, because President Biden will face enormous pressure to use it as harshly as he can against tfg’s cultists while he can, knowing what the faux orange feral toad will do if he gets the Presidency back. While I hope it proves me wrong, this corrupt SCOTUS cannot be trusted at all aside from its three non-right wing justices.
